1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Kamyab Infotech ("CleanShift," "we," "us," or "our"), governing your access to and use of the CleanShift security platform, including the server agent, Guard plugin, dashboard, API, intelligence feeds, and all related services (collectively, the "Service").

By installing the CleanShift Agent, creating a CleanShift account, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, do not install, access, or use the Service.


2. Service Description

CleanShift is an AI-powered server security platform designed for web hosting environments. The Service comprises:

  • CleanShift Agent: A Python-based security agent performing file-system scanning, database-level scanning, WordPress core integrity verification, plugin/theme vulnerability auditing, automated remediation, and real-time file monitoring.
  • CleanShift Guard: A PHP must-use plugin for real-time protection including upload filtering, user creation monitoring, options injection protection, brute-force prevention, and REST API/XML-RPC abuse prevention.
  • CleanShift Dashboard: A web-based dashboard for viewing scan results, managing servers, and configuring the Service.
  • CleanShift API: A central API for scan results, intelligence updates, and centralized management.
  • Intelligence Feeds: Curated threat intelligence including IoCs, CVE data, malware signatures, remediation playbooks, and detection queries.

3. Account Terms

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. You agree to provide accurate, current, and complete registration information and to maintain the confidentiality of your account credentials. You are solely responsible for all activity under your account.


4. Acceptable Use Policy

You may use the Service only on servers you own, lease, or have explicit authorization to manage. You agree not to:

  • Reverse-engineer, decompile, or disassemble any proprietary component of the Service
  • Use the Service to develop a competing product or service
  • Share, resell, or redistribute your API keys or intelligence feeds
  • Use the Service to facilitate any illegal activity
  • Intentionally introduce malware or exploit code into the Service
  • Circumvent or disable any security, rate-limiting, or licensing mechanisms

5. Root Access and Agent Authorization — CRITICAL

THE CLEANSHIFT AGENT REQUIRES AND OPERATES WITH ROOT (SUPERUSER) PRIVILEGES ON YOUR SERVER. By installing the Agent, you expressly authorize CleanShift software to run with root-level access for security scanning, threat detection, file monitoring, and remediation operations.

YOU ACKNOWLEDGE AND AGREE THAT:

  • Root-level software has the technical capability to access, modify, or delete any file or data on the server.
  • While CleanShift is designed to operate within defined security parameters, no software is infallible.
  • You have independently evaluated the risks of running root-level security software and have determined that such risks are acceptable.
  • You are solely responsible for maintaining adequate backups of all data on servers where the Agent is installed.

6. Auto-Remediation and False Positives — CRITICAL

The CleanShift Agent includes automated remediation capabilities that may quarantine, delete, or modify files and database entries identified as malicious.

YOU ACKNOWLEDGE AND ACCEPT THAT:

  • No malware detection system achieves 100% accuracy. False positives and false negatives will occur.
  • Automated remediation acting on a false positive may result in the deletion or modification of legitimate files, database records, or configurations.
  • Such actions may cause website downtime, data loss, broken functionality, or other adverse effects.
  • CleanShift is not liable for any damage, data loss, downtime, lost revenue, or other harm resulting from false-positive detections or automated remediation actions.

YOU MUST MAINTAIN COMPLETE, CURRENT, AND INDEPENDENTLY VERIFIABLE BACKUPS OF ALL DATA ON ANY SERVER WHERE THE CLEANSHIFT AGENT IS INSTALLED.


7. Data Collection and Transmission

The Agent transmits the following metadata: server hostname, IP address, OS info, PHP version, WordPress site paths, plugin/theme names and versions, file paths, file hashes, threat detection details, and agent health data.

The Agent does NOT transmit: file contents, database row data, customer personal data, or passwords. All data processing is described in our Privacy Policy.


8. Intellectual Property

CleanShift and its licensors retain all right, title, and interest in the Service. You retain all right, title, and interest in your data. Scan results belong to you. Intelligence data is licensed for your use in connection with the Service, not sold.


9. Payment Terms

Subscription plans: Free ($0/month, 1 site), Pro ($5/month, up to 5 sites), Server ($12/server/month, unlimited sites), Fleet ($8/server/month, min 5 servers). All fees are in USD, billed in advance, and non-refundable except within the first 14 days of an initial subscription purchase.


10. Term and Termination

You may terminate your account at any time by uninstalling the Agent, disabling the Guard, and requesting account deletion. We may suspend or terminate access for material breach, overdue payment (60+ days), legal requirement, or security risk. Upon termination, account data is deleted within 90 days.


11. Service Availability

We strive for high availability of the CleanShift API and Dashboard but do not guarantee uninterrupted service. The Agent operates locally on your server and does not depend on the API for core scanning functionality.


12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CLEANSHIFT DOES NOT WARRANT THAT THE SERVICE WILL DETECT ALL THREATS, BE ERROR-FREE, OR BE COMPATIBLE WITH ALL SERVER CONFIGURATIONS. YOU USE THE SERVICE AT YOUR OWN RISK.


13. Limitation of Liability

CLEANSHIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, DATA, OR REPUTATION.

TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) FEES PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100. FOR FREE TIER USERS: LIABILITY CAP IS $10.


14. Indemnification

You agree to indemnify, defend, and hold harmless CleanShift from and against any claims, losses, damages, and expenses arising out of your use of the Service, violation of these Terms, failure to maintain backups, or disputes with your hosting customers.


15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States. Disputes are resolved by binding arbitration under the American Arbitration Association (AAA). Class action waiver applies — claims may only be brought individually.


16. Changes to Terms

We may modify these Terms at any time by posting revised Terms and updating the "Last Updated" date. Material changes will be communicated via email and dashboard notices. Continued use constitutes acceptance of modified Terms.


17. General Provisions

These Terms, together with the Privacy Policy and any applicable Order Form, constitute the entire agreement. If any provision is found unenforceable, the remainder stays in effect. No waiver unless in writing. You may not assign these Terms without prior written consent. Force majeure applies. The parties are independent contractors. No third-party beneficiary rights.
